1. Introduction

This Privacy Policy explains how Magic Toushée LLC ("Magic Toushée," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit magictoushee.com (the "Site"), join our waitlist, create an account, place an order, or otherwise interact with us.

By using the Site, you agree to this Privacy Policy. If you do not agree, please do not use the Site.

This policy does not apply to third-party websites or services we link to, which have their own privacy practices.


2. Information We Collect

2.1 Information You Provide

  • Contact and identity information — name, email address, phone number, and mailing address.

  • Order information — shipping and billing address, items purchased, order history, and gift messages.

  • Payment information — payment card or account details are collected and processed directly by our third-party payment processors. We do not store full payment card numbers on our systems. We may receive limited details such as the card type, the last four digits, and the billing ZIP code.

  • Account information — username and password, if you create an account.

  • Waitlist and marketing sign-ups — the email address and, if you choose, the phone number you submit to join our list.

  • Communications — messages, questions, support requests, and feedback you send us, including by email or social media.

  • User content — product reviews, ratings, photos, testimonials, and any content you submit.

  • Promotions — information you provide when entering a contest, sweepstakes, survey, or referral program.

2.2 Information Collected Automatically

When you visit the Site, we and our service providers may automatically collect:

  • Device and connection data — IP address, device type, operating system, browser type, language settings, and unique device or browser identifiers.

  • Usage data — pages viewed, links clicked, items viewed or added to cart, search terms, referring and exit pages, and dates and times of access.

  • Approximate location — general location (such as city, state, or region) inferred from your IP address. We do not collect precise GPS geolocation.

  • Cookies and similar technologies — as described in Section 4.

2.3 Information From Third Parties

We may receive information about you from:

  • our e-commerce, hosting, and website platform;

  • payment processors and fraud prevention services;

  • shipping carriers (for delivery and tracking);

  • email and SMS marketing platforms;

  • analytics and advertising providers; and

  • social media platforms, if you interact with our content or connect an account.

2.4 Sensitive Information

We do not intentionally collect sensitive personal information. We do not request Social Security numbers, government ID numbers, precise geolocation, biometric data, genetic data, financial account login credentials, or information about your health, race, religion, sexual orientation, immigration status, or union membership. Please do not send us this information.
 

3. Children's Privacy

The Site is intended for adults. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of anyone under 16. If you believe a child has provided us personal information, contact us at info@magictoushee.com and we will delete it.
 

4. Cookies and Tracking Technologies

We and our partners use cookies, pixels, tags, web beacons, SDKs, and local storage to operate the Site and understand how it is used. These fall into several categories:

Strictly necessary: Enable core functions such as the shopping cart, checkout, security, and account login. These cannot be turned off.

Performance and analytics: Help us understand how visitors find and use the Site so we can improve it.

Functional: Remember your preferences, such as language or saved cart contents.

Advertising and targeting: Used by us and advertising partners (which may include social media and search advertising platforms) to show you relevant ads on other sites and apps and to measure ad performance.
 

Your choices. You can manage cookies through your browser settings, through any cookie preference tool available on our Site, and through the opt-out resources listed in Section 8. Blocking some cookies may affect how the Site works.

Global Privacy Control. We honor the Global Privacy Control (GPC) browser signal as a valid request to opt out of the sale or sharing of personal information and of targeted advertising, where required by law. Because GPC operates at the browser and device level, you will need to enable it on each browser and device you use.
 

5. How We Use Your Information

We use personal information to:

  • process, fulfill, ship, and confirm your orders, and handle returns, exchanges, and refunds;

  • process payments and prevent fraudulent or unauthorized transactions;

  • create and manage your account and our waitlist;

  • respond to your questions and provide customer service;

  • send transactional messages such as order confirmations, shipping notices, and policy updates;

  • send marketing and promotional communications, where permitted or with your consent;

  • personalize your experience and show you relevant products and offers;

  • measure, analyze, and improve the Site, our products, and our marketing;

  • conduct advertising, including targeted advertising and measurement;

  • administer contests, promotions, surveys, and referral programs;

  • maintain the security and integrity of the Site and protect our rights and the rights of others;

  • comply with legal obligations, including tax, accounting, and consumer protection requirements; and

  • carry out a merger, acquisition, financing, or sale of assets.
     

6. How We Disclose Your Information

We do not sell your personal information for money. We disclose personal information as follows:

  • Service providers. Companies that perform services for us, including website hosting and e-commerce platform providers, payment processors, shipping and fulfillment partners, email and SMS marketing platforms, customer support tools, analytics providers, and fraud prevention services. They are permitted to use the information only to provide services to us.

  • Advertising and analytics partners. We may allow advertising and analytics partners to collect information about your activity on the Site through cookies and similar technologies in order to deliver and measure advertising. Under some state privacy laws, this may be considered a "sale" or "sharing" of personal information. See Sections 7 and 8.

  • Social media platforms. If you interact with our social media content or use social features on the Site.

  • Legal and safety. When we believe disclosure is required by law, subpoena, or legal process, or is necessary to protect our rights, safety, property, or that of others, or to investigate fraud or violations of our Terms & Conditions.

  • Business transfers. In connection with a merger, acquisition, reorganization, financing, bankruptcy, or sale of all or part of our business, in which case personal information may be transferred as a business asset.

  • With your direction or consent. For any other purpose disclosed to you at the time we collect the information.

  • Aggregated or de-identified information. We may use and disclose information that cannot reasonably be used to identify you, and we will not attempt to reidentify it.
     

7. "Sale" and "Sharing" Under State Privacy Laws

We do not exchange personal information for money. However, our use of advertising and analytics cookies may constitute a "sale" or "sharing" of personal information for "targeted advertising" or "cross-context behavioral advertising" as those terms are broadly defined under California, Colorado, Connecticut, Texas, Virginia, and other state privacy laws.

The categories of information involved may include identifiers, internet and network activity, commercial information, and inferences. The categories of recipients are advertising networks, social media platforms, and analytics providers.

You may opt out at any time by enabling Global Privacy Control in your browser, or by contacting us at info@magictoushee.com.

We do not knowingly sell or share the personal information of consumers under 16 years of age.
 

8. Your Choices

  • Marketing email. Click "unsubscribe" in any marketing email, or email us. We may still send transactional messages about your orders and account.

  • Text messages. Reply STOP to any marketing text to opt out, or HELP for help. Message and data rates may apply.

  • Cookies. Adjust your browser settings, use our cookie preference tool where available, or enable Global Privacy Control.

  • Targeted advertising. You can opt out of interest-based advertising from participating companies through the Digital Advertising Alliance (optout.aboutads.info), the Network Advertising Initiative (optout.networkadvertising.org), and, for mobile apps, your device's advertising settings. These opt-outs are browser- and device-specific.

  • Account information. Log in to review or update your account details, or contact us for help.
     

9. Your Privacy Rights

Depending on where you live, you may have some or all of the following rights regarding your personal information:

  • Know / Access — confirm whether we process your personal information and obtain a copy, including the categories collected, sources, purposes, and recipients.

  • Correct — request correction of inaccurate personal information.

  • Delete — request deletion of personal information we have collected from you.

  • Portability — receive your personal information in a portable, readily usable format.

  • Opt out — opt out of the sale or sharing of personal information, of targeted advertising, and of profiling that produces legal or similarly significant effects.

  • Limit sensitive information — limit our use of sensitive personal information (note that we do not intentionally collect it).

  • Non-discrimination — we will not deny you goods or services, charge you a different price, or provide a different level of quality because you exercised a privacy right.

  • Appeal — if we decline your request, you may appeal by replying to our decision. We will respond to appeals as required by your state's law, and you may contact your state Attorney General if you have concerns about our response.
     

How to Submit a Request

Email info@magictoushee.com with the subject line "Privacy Request" and tell us which right you want to exercise.

Verification. To protect your information, we will take reasonable steps to verify your identity before responding, which may include asking you to confirm details we already have on file, such as an email address used to place an order. We will not use verification information for any other purpose.

Authorized agents. You may use an authorized agent to submit a request on your behalf. We may require written proof of the agent's authority and may ask you to verify your own identity directly.

Timing. We will acknowledge and respond to requests within the timeframes required by applicable law — generally within 45 days, with one extension of up to an additional 45 days where reasonably necessary, and we will notify you if an extension is needed.

Limits. We may decline a request where an exception applies, such as when we must retain information to complete a transaction, comply with a legal obligation, detect security incidents, or prevent fraud.
 

10. California Disclosures

10.1 Categories of Personal Information

In the preceding 12 months, we have collected and disclosed for a business purpose the following categories of personal information under the California Consumer Privacy Act:

  • L. Sensitive personal information is not collected

10.2 Shine the Light

California Civil Code § 1798.83 permits California residents to request information about disclosure of personal information to third parties for their direct marketing purposes. To make such a request, email info@magictoushee.com with the subject "Shine the Light Request."

10.3 Notice of Financial Incentive

If we offer a discount, free shipping, or other benefit in exchange for joining our email or SMS list, that program may be considered a financial incentive. The personal information collected is your email address and, if provided, your phone number. The value of this information to us is reasonably related to the cost of the offer. Participation is voluntary, and you may withdraw at any time by unsubscribing.


11. Nevada Residents

Nevada residents may submit a request directing us not to sell certain "covered information" as defined under Nevada law. Email info@magictoushee.com with the subject "Nevada Opt-Out Request."
 

12. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this policy, including to fulfill orders, maintain business records, resolve disputes, and comply with legal, tax, and accounting obligations. Retention periods vary based on the type of information and the reason we hold it. When information is no longer needed, we delete it or de-identify it.
 

13. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, and we rely on established third-party platforms for payment processing and site hosting. However, no method of transmission or storage over the internet is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account password confidential.
 

14. Third-Party Links and Social Media

The Site may link to or embed third-party services, including social media platforms. We do not control those services, and their collection and use of information is governed by their own privacy policies. We encourage you to review them.
 

15. Where Your Information Is Processed

We currently operate in and sell to customers in the United States, and personal information we collect is stored and processed in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country.
 

16. Do Not Track

Some browsers offer a "Do Not Track" setting. Because no common industry standard for responding to those signals has been adopted, we do not currently respond to Do Not Track signals. We do honor Global Privacy Control signals, as described in Section 4.
 

17. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent version. If we make material changes, we will provide notice as required by law, such as by posting a notice on the Site or emailing you. Your continued use of the Site after the effective date constitutes acceptance of the updated policy.
